NZ Gold Buyers (“we”, “us”, “our”) is a licensed precious metals dealer at 11C Enterprise Street, Birkenhead, Auckland 0626, New Zealand. We respect your privacy and handle personal information in line with the Privacy Act 2020 and its Information Privacy Principles.
This policy explains what personal information we collect, why we collect it, how we use and protect it, and the rights you have. It applies to:
- our website, https://nzgoldbuyers.co.nz (the “Website”)
- the NZ Gold Buyers mobile app for iOS and Android (the “App”)
- your dealings with us in store, by phone, by email and on WhatsApp
By using the Website, the App or our services, you agree to this policy.
2. Information we collect
When you contact us
If you call, email, message us on WhatsApp or fill in a form on the Website, we collect the details you give us. This usually includes your name, phone number, email address and information about the items you want to sell.
When you sell items to us
As a licensed dealer, the law requires us to identify the people we buy from and keep records of each purchase. When you sell to us, we collect:
- your full name, address and contact details
- a copy or record of your photo identification, such as a driver licence or passport
- a description of the items you sell, including weight, purity and photographs
- the price paid, the date and the payment method
- your bank account details, if you choose to be paid by bank transfer
We may also record images of you and our premises on CCTV for security purposes.
When you use the App
The App shows live precious metal prices and a scrap value calculator. It does not require an account and does not collect personal information such as your name, email, contacts or location.
- Your settings, such as currency and weight unit, and the weights you enter in the calculator are stored only on your device. They are not sent to us.
- To show live prices, the App requests price data from our servers or our price data provider over a secure (HTTPS) connection. Like any internet request, this involves your device’s IP address, which is used only to deliver the data.
When you visit the Website
Our Website and hosting provider automatically record standard technical information, such as your IP address, browser type, the pages you visit and the date and time of your visit. We may use cookies and analytics tools to understand how the Website is used (see section 7).
3. How we use your information
We use personal information only for the purposes it was collected for, or a directly related purpose:
- to respond to your enquiries and give you a valuation or quote
- to test, weigh, value and buy your items
- to pay you, by cash or bank transfer
- to meet our legal obligations, including record-keeping under the Secondhand Dealers and Pawnbrokers Act 2004 and, where it applies, the Anti-Money Laundering and Countering Financing of Terrorism Act 2009
- to prevent and detect fraud, theft and the sale of stolen goods
- to keep our premises, staff and customers safe
- to run, maintain and improve the Website and the App
We do not use your information for automated decision-making, and we do not send you marketing unless you ask us to. You can opt out of any marketing at any time.
4. Sharing your information
We do not sell, rent or trade your personal information. We share it only when needed:
- NZ Police and government agencies, when the law requires it. For example, licensed dealers must make purchase records available to Police on request.
- Service providers who help us run the business, such as our website host, IT and email providers, accountants and banks. They may use your information only to provide services to us.
- Professional advisers, such as lawyers and auditors, where needed.
- Anyone else you authorise, or where disclosure is otherwise permitted under the Privacy Act 2020, for example to prevent a serious threat to someone’s life or health.
The App’s price data provider receives technical requests for prices only. It does not receive any personal information about you.
5. Storage, security and retention
We take reasonable steps to protect personal information from loss, misuse and unauthorised access, use, change or disclosure. These include secured paper records, password-protected systems, access limited to staff who need it, and encrypted (HTTPS) connections for the Website and the App.
Some of our service providers, such as cloud hosting and email providers, may store information outside New Zealand. When this happens, we take reasonable steps to make sure the information is protected to a standard comparable to the Privacy Act 2020.
We keep personal information only for as long as we need it for the purposes above, or for as long as the law requires. Purchase and identity records are kept for the periods required by dealer licensing and other applicable laws. We then securely destroy or anonymise it.
If a privacy breach is likely to cause serious harm, we will notify the people affected and the Office of the Privacy Commissioner, as the Privacy Act 2020 requires.
6. Your rights
Under the Privacy Act 2020 you have the right to:
- ask whether we hold personal information about you, and to access it
- ask us to correct information that is wrong, incomplete or out of date
To make a request, contact our Privacy Officer using the details in section 9. We will respond within 20 working days, and we do not charge for access requests in most cases. If we refuse a request, we will tell you why, as far as the law allows.
We may not be able to delete records that the law requires us to keep, such as purchase and identity records.
If you are not satisfied with how we handle your information, please talk to us first. If we cannot resolve it, you can complain to the Office of the Privacy Commissioner at privacy.org.nz or on 0800 803 909.
7. Cookies and analytics
The Website uses cookies, which are small files stored by your browser, to make the site work and to understand how visitors use it. We may use analytics tools such as Google Analytics, which collect information like pages viewed and time on site in a way that does not directly identify you.
You can block or delete cookies in your browser settings. Some parts of the Website may not work properly if you do. The App does not use cookies or advertising trackers and shows no ads.
8. Other things you should know
